Dear Brothers, Sisters and Friends of Santo Daime,
We would like to inform you about the actions already taken for the legalization of our Sacrament
in France.
After the classification established by the Minister of Health (in April 2005) the plants
Banisteriopsis caapi e Psychotria viridis, which are constituent parts of the Ayahuasca, our
Sacrament has been prohibited in France. Therefore, we can no longer practice our religion with
freedom as our Sacrament can not be set apart from our Rite. It is a serious attack to religion liberty
and human rights.

In July 2005, on behalf of the association "Liberté du Santo Daime" we made a judicial appeal to
the State Council requiring the end of this prohibition. Jacques Mabit, the association "La maison
qui chante" and Ghislaine Bourgogne, its President as well as several other friends have gota
together to present this appeal.

After the presentation of our request, the Minister of Health used their right of response (in
February 2006) and taking into account the present procedures, we have the right make a new
appeal or not. After several reflections we decided to respond to the Minister of Health, which goes
on giving us and our Sacrament a hell of a hard time. You may read more about our appeal as well
as the answer of the Ministry at: http://libertedusantodaime.free.fr
After the response, we are now in charge of writing, which is called here reply , the Ministry of
Health may or not come out with a new answer. The argumentation will be ended after that and the
State Council will take their decision, with no chance of a new effort of defense and we believe we
ought to have our right to show our ideas to all tribunes. A deadline for the final position has not
been established.

We believe we can be optimistic, we may trust the wisdom of the highest administrative authorities
of our country, expecting them to recognize and grant us our rights. When we read the arguments of
the Ministry of Health justifying their position we can feel the arbitrary spirit in them and we point
out the article published in the Libération on May 6th, 2005 “..... it is a decision based on other
criteria apart from scientific objectiveness, obedient to other motives but not to Public Health !”.
At this moment, more than we may have done before, we want to be recognized as a Religion where
Ayahuasca is the Sacrament and all the attacks against our rights to freely practice our religion
within the boundaries of our country, shall be considered an attempt against the Human Rights.
Furthermore, in case of negative reply from the State Council, we have already come to a decision
to present our requirements to the European Justice Court. We also want to make clear that we have
always been in favor of some legislation, so that the Ayahuasca may not be misused as some other
Sacred plants are. We reaffirm our will to keep a dialogue with the national authorities so as to find
the best way to respect the decisions of the public health and our right to go on practicing our
Religion without restrictions.

We send you our fraternal and friendly regards,

Claude Bauchet
Association President "Liberté du Santo Daime"
